General Terms and Conditions of Sale and Delivery

Delivery Time
The delivery date stated in the confirmation will be observed where possible but is non-binding.

Delivery
According to the respective agreement in force.

Claims
Differences in quantities and transport damage must be reported immediately upon receipt of the goods. Other defects must be reported within a reasonable time, but no later than 8 days after receipt. Transport damage involving SBB must be reported to the responsible freight distribution center.

Price
Prices stated in our order confirmation are exclusive of VAT and may vary. Increases in material costs, labor costs, new or increased duties, transport costs, wage increases, exchange rate fluctuations, and similar factors occurring after the offer or order confirmation may result in an adjustment of the purchase price.

Payment Terms
Prices are net and payable within 30 days from the invoice date, unless otherwise agreed.
Unauthorized cash discounts will be charged subsequently. In the event of late payment, we reserve the right to charge 5% default interest without prior notice.

Retention of Title
The delivered goods remain the property of BenchTech Allemann AG until full payment of the purchase price has been made. BenchTech Allemann AG is entitled to register the retention of title in accordance with Art. 715 of the Swiss Civil Code at the customer’s place of residence. By signing the contract (and delivery note), the customer agrees, in accordance with Art. 4 of the Federal Supreme Court ordinance regarding the registration of retention of title, that the supplier may register it without further involvement from the customer.

Warranty
A warranty is granted on all items (according to the terms of the respective manufacturer). The invoice date is decisive. Damage resulting from improper handling is not covered by the warranty. No warranty is provided for supplied covering materials, wood samples, or color samples.

Jurisdiction and Place of Performance
The place of jurisdiction and performance for both parties is 2500 Biel. Swiss law shall apply.
